The short version: the data is licensed for your organization’s internal business use, it describes commercial venues as publicly listed at the stated collection dates, and it may not be resold or used to profile individuals.

A Market File is a one-off delivery generated from the latest completed collection for an agreed market scope. Market Monitor is an annual subscription adding rolling collection, preserved monthly comparison snapshots and scheduled delivery for agreed scopes. API access is a delivery method for the same data under the same license.
You receive a non-exclusive, non-transferable license to use the delivered data inside your organization for market analysis, expansion and acquisition screening, and sales-territory planning. Excerpts may appear in your internal documents and diligence materials with attribution to tallywire. You may not resell, republish, sublicense or redistribute the dataset or substantial parts of it, offer it as part of a competing data product, or use the full files to train publicly available models, without a separate written agreement.
No re-identification of private individuals, no building of consumer profiles, no enrichment with consumer data, and no unlawful or discriminatory targeting. Outreach to businesses in the data remains your responsibility under the marketing and privacy laws that apply to you.
The data reflects publicly listed business information observed across covered sources during the collection window stated on each delivery. It is not an audited census: completeness and accuracy are not guaranteed, counts carry the unit definitions in the methodology, provider records are deduplicated per source unless a delivery states otherwise, and review or rating figures are visibility proxies rather than revenue. Prices are provider-published list prices at observation time.
If you find an error, tell us and we correct or annotate it in the next refresh. Venue owners can request correction or removal at any time; we handle those with priority, typically within a few business days.
Market Files are invoiced on delivery of the agreed scope; the fee is credited in full toward a Market Monitor agreement signed within 30 days. Market Monitor is billed annually in advance. API usage limits are agreed per engagement and subject to fair use.
The data is provided as described above, without further warranties. Our total liability under these terms is capped at the fees you paid in the twelve months before the claim. Nothing here limits liability that cannot be limited by law.
Market File licenses are perpetual for internal use of the delivered snapshot. Monitor and API licenses run for the subscription term; on termination you delete undelivered feeds and API copies but may keep delivered files and your own analyses under this license.
These terms are governed by Dutch law; disputes go to the competent courts of the Netherlands. We may update these terms for future deliveries; the version you bought under stays applicable to that delivery.
